A family council is an independent group of relatives and friends of nursing home residents that meets regularly to advocate for improved care and quality of life.

Protected by federal law, these groups allow families to confer in private, support one another, and present united concerns to facility administration

Your Rights & Facility Responsibilities

  • Federal Protections: Under federal law (42 CFR § 483.10(f)(5)), nursing homes are legally required to allow families to organize and participate in councils without interference.

  • Privacy: Meetings must be held privately, without facility staff present (unless invited by the council).

  • Designated Space: The facility must provide a private space for meetings and assist with setting them up upon request.

  • Mandatory Response: The nursing home must listen to, act upon, and provide a written response to the group's concerns and recommendations
